Interface Planning Casebook - Case File 5

In the Bulkley Valley, it is common practice for rural landowners whose properties lie along the Interface to close both old but gazetted public roads and newly proclaimed public rights-of-way to members of the public. In several recent instances such barriers were erected within just a year or two of subdivision permission being granted with explicit provision of the right of public passage to Crown lands beyond the subdivision. In other instances, planning technicians in the Ministry of Transportation and Highways have given the land owners permission to gate off the road. The effect is to deny the public recreational access to its own land, over roads it has paid to build or survey. On the other side of the matter, public rights-of-way often distress land owners because they encourage trespass and nuisance.

Class of Problem

What seems to be involved here is lack of understanding that the Interface lands are extremely important to the Interface public for recreational purposes and that timorousness in enforcing the plans in this respect, or in policing trespass, renders planning meaningless.
